Early Neutral Evaluation
The
purpose of Early Neutral Evaluation (ENE) is to enable disputing parties to
identify, through a neutral and experienced evaluator, the legal issues arising
from the conflict, evaluate their complexity and prospects, and become
acquainted with the relevant facts and evidence, focusing on factual and legal
aspects, rather than on interests.
We bring to the process extensive knowledge and experience that allow us to analyze the legal issues at hand and, if the parties wish to end the dispute, formulate a proposal for its resolution. Alternatively, the ENE enables the parties and their representatives to decide how or if they wish to continue the legal proceeding.
It is possible to conduct an ENE, either ex parte or in the presence of all of the parties involved, in order to obtain an additional expert opinion by a qualified neutral evaluator who assists the parties in anticipating the outcome of litigation proceedings in court.
